RE: Citisteel (Former EVRAZ-Claymont Steel) OU-6, 1-25-17 Proposed Plan Date

Please let me introduce myself. My name is Tim Ratsep and I am the Program Administrator to DE DNREC Site Investigation and Restoration Section. I am responsible for signing the Proposed and Final Plan of Remedial Action. I appreciate the service Electronic Review for the Environment is providing because we here at DNREC understand the importance of public participation in areas that directly affecting the citizens of Delaware. Under 7 Del C. Ch 9107(a)(1) “Such public notices shall be published in a newspaper of general circulation in the county in which the facility is located”. You comment is correct that unfortunately the public notice was not shown on the State of DE Dept. of Natural Resources and Environmental Control Public Notice. Please note that is was in error; however the Department did fulfill is legal requirement to notice “in a newspaper of general circulation in the county in which the facility is located”. A notice appeared in The News Journal on January 29, 2017 (please see attached). DNREC will work diligently in the future to provide additional notifications whenever possible.
Your second comment regarded finding documents within the Delaware Environmental Navigator (DEN) database. Your specific comment was that it was not clear from the listing which document pertained to the public comment period for OU-6. I would like to note that your “screen shot” showed Program ID numbers. One Program ID number was DE-0046 in addition to listing the program as the Site Investigation and Restoration Section (SIRS). The attached legal notice clearly documented that this Site is DE-0046. DEN is set up by Facility and not by Operable Units (OUs); therefore DE-0046 you will find all documents relating to this facility not just OU-6. I understand that you submitted a comment regarding another facility this past week. As part of DNREC’s response to that comment we provide instructions on how to navigate through DEN. I would suggest utilizing these instructions because it will allow your organization to become more familiar with this useful database.
In conclusion, DNREC has determined that it has fulfilled its obligations under 7 Del C. Ch 91; therefore your request to re-open the public comment period is denied. I have attached my contact information below if you wish to discuss further.

However there was not public notice shown on the State of Delaware Dept. of Natural Resources and Environmental Control Public Notices page so the noticing for this project document appears to have been deficient.
I attempted to view relevant documents related to OU-6 via the navigator system and came up with this:

However, it was not clear from this listing which document pertained to the public comment period at OU-6.
Based on these deficiencies in public noticing, I would like to request additional information as to where I can view the documents relevant to this public comment period and request re-opening the pubic comment period to allow additional time for viewing the documents.
