We just received the document about the time that the public comment period ended. Since it would take time to pass this along to an environmental reviewer, we would need additional time to review the document. If you could extend it just 7 days, we will review it and provide comments (if we have any).
 
It is my understanding that a reasonable request for an extension should be granted for projects like this. Since we have made a reasonable request for an extension, please explain why you will not extend the public comment period.
 
And please send your responses to my previous comments (via email):
   1) In response to my request for you to include an email address on the public notice, you stated that you don't do that and what you do is include a phone number. Can you please explain why you do not include email addresses and only include phone numbers? (please provide justification why you will not place email addresses on your public notices).
 
   2)  Since you have indicated that you can send an electronic link to me to view these documents online, can you also reissue the public notice with the electronic link included on the public notice?
 
    3) Since links for documents under your regulatory oversight are available for viewing online, please include links to those documents in your future public notices under the Division of Air. Can you do that to foster community involvement?

1)      At present, including an email address is not required.  This is something that we are exploring, however it’s important that we ensure consistency and stability in this process.

2)      The public notice will not be reissued at this time.  Information is available as stated in the public notice.

3)      As I have stated, we are exploring some of your suggestions but any changes to the public notice process must be done with consideration as stated above.  I appreciate and share your concern regarding community involvement.

Thank you for your comments.  In response to your questions:

1)      We do not presently use an email address for public notices.  At present, we are continuing with the phone number. 

2)      The document is available at our offices and also online.  Would you like me to send the link?

3)      The information can be requested by interested parties.  The notice does not need to be reissued.

4)      The notice period still has 10 days remaining.  An extension is not warranted.

LEGAL NOTICE 

7 DE Admin. Code 1102 NATURAL MINOR PERMIT APPLICATIONS 

Notice has been given that: 

Seaford AgriSoil, LLC requests a permit to operate one (1) 48 kW Komptech MultiStar L3 screen and one (1) Terrex CBI grinder equipped with a 765 HP (570 kW) engine at their Sussex County composting facility located at 28338 Enviro Way in Seaford.  The screen has the potential to emit up to 2.02 pounds per hour and 8.86 tons per year (TPY) of nitrogen oxides (NOX), 0.16 pounds per hour and 0.72 TPY of volatile organic compounds (VOCs), 0.44 pounds per hour and 1.91 TPY of carbon monoxide (CO), 0.14 pounds per hour and 0.63 TPY of particulate matter (PM), and 0.13 pounds per hour and 0.59 TPY of sulfur oxides (SOX).  The screen will be permitted to emit the same hourly rates and up to 2.19 TPY of NOX, 0.18 TPY of VOCs, 0.47 TPY of CO, 0.16 TPY of PM, and 0.15 TPY of SOX by Permit: APC-2017/0119-OPERATION.  The grinder engine is EPA Tier 2 certified and will be permitted to remain on location through December 2, 2017 by Permit: APC-2017/0119-OPERATION. 

The application for this permit may be reviewed at the offices of the Division of Air Quality, State Street Commons, 100 W. Water Street, Suite 6A, Dover, Delaware or 715 Grantham Lane, New Castle, Delaware.  For additional information or for an appointment to review the application, please contact Tracy Mattson at (302) 7399402. 

A public hearing on any of the above applications will NOT be held unless the Secretary of DNREC receives a request for a hearing regarding that application within 15 days from the date of this notice, ending Monday August 14, 2017.  A request for a hearing shall be in writing.  The request must also show a familiarity with the application and a reasoned statement of the permit’s probable impact.
